Broker Affiliation Disclosure (California)
The Property Management Company is affiliated with, or may be owned or controlled by, a California-licensed real estate broker or brokerage firm (“Affiliated Broker”), as defined under the California Business and Professions Code. This affiliation is disclosed in compliance with applicable California real estate laws and regulations, including disclosure requirements enforced by the California Department of Real Estate (DRE).
The Property Management Company acts solely in its capacity as a property manager and not as a real estate broker in connection with this Agreement, unless expressly stated otherwise in a separate written brokerage or agency agreement. No Affiliated Broker shall be deemed to represent the property owner or tenant in any real estate transaction unless such representation is established by a separate written agreement in accordance with California law.
Property owners and tenants are not required to use the services of any Affiliated Broker and are free to select a real estate broker of their choice. Any real estate brokerage services, including leasing, sales, or agency representation, shall be governed by a separate written agreement and may involve additional fees or commissions as permitted by law.
Relationship to BRG Realty
Willowby Properties operate under and is affiliated with BRG Realty, a California-licensed real estate brokerage. BRG Realty provides brokerage oversight in accordance with California law. We perform property management services only and does not act as a real estate broker or agent in connection with the sale, purchase, or leasing of real property unless expressly authorized in writing under a separate brokerage or agency agreement.
The existence of this relationship does not require any Owner or Tenant to engage BRG Realty for brokerage services, and all parties retain the right to select a real estate broker of their choosing. Any brokerage services, if applicable, shall be governed by a separate written agreement and may involve additional compensation as permitted by law.
Scope of Property Management Services
Willowby Properties is responsible only for those duties expressly set forth in this Agreement. We does not guarantee the condition of the Property, the performance of tenants, or the profitability or suitability of the Property for any particular purpose.
No Legal, Tax, or Financial Advice
Willowby Properties does not provide legal, tax, accounting, or financial advice. Owners and tenants are advised to consult with qualified professionals of their own choosing regarding legal rights, tax consequences, or financial matters related to the Property or this Agreement.
Independent Contractors and Vendors
Willowby Properties may engage independent contractors or vendors to perform services related to the management, maintenance, or repair of the Property. Such contractors are not employees or agents of Willowby Properties, and we do not warrant or guarantee the work performed by any third party.
No Agency Beyond Management Authority
Unless otherwise expressly agreed to in writing, Willowby Properties does not act as a real estate broker or agent for the purpose of selling, purchasing, or leasing real property. Any agency relationship for brokerage services must be established by a separate written agreement in accordance with California law.
Reliance on Information Provided
Willowby Properties may rely on information provided by the Owner, Tenant, or third parties and shall not be responsible for verifying the accuracy of such information unless otherwise required by law or expressly agreed to in writing.
Fair Housing and Legal Compliance
Willowby Propertiesoperates in compliance with applicable federal, state, and local fair housing and non-discrimination laws. All applicants and tenants are evaluated based on lawful, objective criteria applied consistently.
Limitation of Responsibility
To the extent permitted by law, we shall not be liable for losses, damages, or delays caused by events beyond its reasonable control, including but not limited to acts of third parties, governmental actions, or natural events.
